Welcome to WasteBoutique (hereinafter, "the Platform"), accessible through the website www.wasteboutique.com. By accessing, registering or using the Platform, you accept these Terms and Conditions of Use (hereinafter, "the Terms"). If you do not agree with any of these Terms, we ask that you refrain from using the Platform.

1Nature and Purpose of the Platform

WasteBoutique is a digital exhibition and information platform whose purpose is to promote the circular economy by connecting people and companies that generate waste, residues or industrial by-products with those who can reuse, recycle or give them a new productive use.

The Platform operates exclusively as an exhibition and contact space. It is not a marketplace, online store or e-commerce platform. WasteBoutique does not participate, intermediate or facilitate commercial transactions, payments, shipments or agreements of any kind between users.

The Platform does not charge commissions, fees or percentages on operations that users may carry out between themselves outside the Platform.

2Disclaimer of Liability

By using the Platform, the user acknowledges and accepts that WasteBoutique:

Any commercial or other relationship arising between users is carried out under the exclusive responsibility of the parties involved. WasteBoutique acts in good faith and trusts the accuracy of information provided by users, but does not verify or validate it.

3Registration and User Account

To publish material offers on the Platform, it is necessary to create a user account through the provided authentication system. By registering, the user agrees to:

• a)Provide truthful, complete and up-to-date information.
• b)Maintain the confidentiality of their access credentials.
• c)Not create fake accounts or impersonate third parties.
• d)Be responsible for all activity carried out from their account.

4Publications and User Content

Users who publish material offers on the Platform declare and guarantee that:

• a)The published information is truthful and faithfully describes the characteristics of the offered material.
• b)They have ownership or legal authorization to dispose of the published materials.
• c)The published materials do not contravene environmental, health or any other applicable legislation in their jurisdiction.
• d)They will not publish hazardous, toxic, radioactive or illegal materials without the corresponding authorizations and warnings.

WasteBoutique reserves the right to review, moderate, edit or remove any publication it considers inappropriate, misleading, illegal or in violation of these Terms, without prior notice.

5Environmental and Regulatory Responsibility

Each user is solely responsible for complying with all applicable environmental, health, transport and waste management laws, regulations, standards and permits in their country, state, municipality or corresponding jurisdiction.

WasteBoutique promotes the circular economy and responsible waste management, but does not verify or certify that users comply with applicable regulations. Non-compliance with environmental or other regulations is the exclusive responsibility of the offending user.

6Intellectual Property

All content on the Platform, including but not limited to logos, designs, texts, graphics, images, software and source code, is the property of WasteBoutique or its respective owners and is protected by applicable intellectual property laws.

By publishing content on the Platform, the user grants WasteBoutique a non-exclusive, free and revocable license to display such content within the Platform for the purpose of fulfilling its exhibition and circular economy promotion purpose.

7Limitation of Warranties

The Platform is provided "as is" and "as available". WasteBoutique does not guarantee that the service will be uninterrupted, error-free, secure or virus-free. Use of the Platform is at the user's own risk.

To the maximum extent permitted by law, WasteBoutique excludes all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

8Indemnification

The user agrees to indemnify, defend and hold harmless WasteBoutique, its directors, employees and collaborators, against any claim, demand, damage, loss, liability, cost or expense (including attorney's fees) arising as a result of the use of the Platform, violation of these Terms, or infringement of third-party rights by the user.

9Modifications to the Terms

WasteBoutique reserves the right to modify these Terms at any time. Modifications will take effect from their publication on the Platform. Continued use of the Platform after the publication of changes constitutes acceptance of the modified Terms. Users are recommended to periodically review this page.

10Termination

WasteBoutique may suspend or cancel a user's access to the Platform at any time and without prior notice if it considers that the user has violated these Terms, has provided false information, or has acted in a manner harmful to the Platform or other users.

11Applicable Law and Jurisdiction

These Terms shall be governed and interpreted in accordance with the laws of the Republic of Colombia. Any dispute arising in connection with these Terms shall be submitted to the competent courts of Colombia.
